Obamacare back before the US Supreme Court

On Wednesday, March 4, 2015, the US Supreme Court heard arguments on the legality of this controversial law.  The legal challenges include that the federal government is requiring states to take certain actions that maybe unconstitutional for the federal government to require.

Under this law those who choose to self-insure themselves due to high insurance costs are punished and pay a tax penalty required by the federal government.   Also many that I have spoken with who have sought to purchase health insurance through this government program have found it too expensive to be practical. These people work full time.  Another person I know does not qualify because they own their home. The only person that I know who has gotten the federal government to pay for most of his health insurance is a young 27 year old male who refuses to work and gets away with it because his parents pay his personal expenses.

A previous legal challenge to this law was defeated when the law was upheld by the US Supreme Court.  It was upheld, as Chief Justice Roberts pointed out, because it is a “Tax Bill”. It creates a new set of taxes on Americans. Congress has the authority to create new tax laws. It is being challenged on other grounds this time.

The law has received recent attention when video clips of the man who designed Obamacare became public.  In those videos the man makes fun of the law. He acknowledges the cumbersomeness and structure of the law itself would not work well in reality. It was packaged and sold as viable when it was not.

We will see what the Supreme Court does with this controversial law.  The law could remain in effect, have parts of it stricken or be totally thrown out as unconstitutional.
